Delhi & Haryana's Latest Move: A Breath of Fresh Air or a Blow to the Common Man?

The National Capital Region (NCR), including Delhi and parts of Haryana, is once again at the forefront of a contentious environmental policy. Effective July 1, 2025, a new directive mandates that "end-of-life" vehicles – specifically diesel vehicles older than 10 years and petrol vehicles older than 15 years (which would primarily encompass BS4 and older emission standards) – will no longer be allowed to refuel. To enforce this, petrol pumps are being equipped with advanced sensors and CCTV cameras to identify and deny fuel to non-compliant vehicles.
While the stated aim is to curb alarming levels of air pollution, this policy has ignited a fierce debate, raising critical questions about its legal standing, practical implementation, environmental efficacy, and perhaps most importantly, its significant impact on the economy and the pockets of ordinary citizens.
The Legal Landscape: A Stance Rooted in Precedent
This latest move isn't entirely new territory for the judiciary. The ban on older vehicles in Delhi-NCR finds its roots in directives from the National Green Tribunal (NGT) and subsequent reinforcement by the Supreme Court. As early as 2018, the Supreme Court upheld the NGT's ruling to prohibit diesel vehicles older than 10 years and petrol vehicles older than 15 years from plying in Delhi. The current policy is essentially an enforcement mechanism to actualize these existing judicial orders.
The courts have consistently emphasized public health and the right to clean air, often prioritizing environmental concerns over individual vehicle ownership rights. This gives the government's current policy a strong legal backing, as it aligns with previous judicial pronouncements aimed at combating severe air pollution.
Implementation Woes and Arbitrary Concerns: More Questions Than Answers?
While legally supported, the implementation of this policy raises several eyebrows:
 * "End-of-Life" Definition: The blanket age-based definition of "end-of-life" is a major point of contention. A well-maintained 10-year-old diesel car could potentially be less polluting than a poorly maintained newer vehicle. This age-based ban fails to account for actual emission levels, which could be scientifically determined through rigorous PUC (Pollution Under Control) checks.
 * Sensor Reliability: The reliance on sensors and ANPR (Automatic Number Plate Recognition) cameras at petrol pumps for real-time identification of non-compliant vehicles needs to be foolproof. Any errors could lead to unnecessary harassment for vehicle owners.
 * Lack of Scrappage Incentives: A critical missing piece is a robust and attractive vehicle scrappage policy. Without adequate incentives, owners are left with valuable assets suddenly deemed worthless, forcing them into a difficult financial corner.
 * Pan-NCR Uniformity: While the policy targets Delhi and parts of Haryana, the interconnectedness of the NCR means a patchwork implementation can create confusion and loopholes, with vehicles simply crossing borders to refuel.
Economic Ripples: A Hole in the Pockets of Voters
The economic ramifications of this policy are substantial and immediate, particularly for the middle class and small businesses:
 * Sudden Depreciation of Assets: Millions of vehicle owners, who paid road tax for 15 years (even for diesel vehicles that are now banned at 10 years), find their significant investments rendered valueless overnight. This is a direct financial hit for families who often rely on their vehicles for daily commute, livelihoods, or essential services.
 * Forced New Vehicle Purchases: The policy is expected to drive a surge in demand for new vehicles, providing a boost to the automobile industry and government tax revenues. However, for many, purchasing a new car is a significant financial burden, often requiring loans and stretching household budgets.
 * Impact on Livelihoods: Small traders, delivery drivers, and service providers who depend on their older vehicles for their livelihood are disproportionately affected. Without a viable alternative, many face the prospect of unemployment or significant disruption to their businesses.
 * Exacerbating Economic Stress: In an economy still grappling with various challenges, such a broad-brush policy adds another layer of financial stress on the populace, creating discontent and frustration among voters.
Environmental Efficacy: A Band-Aid on a Deeper Wound?
While the intent is clear – to reduce air pollution – questions linger about the actual environmental impact and whether this policy addresses the root causes:
 * Vehicular vs. Other Pollutants: While vehicular emissions are a significant contributor to air pollution, they are not the sole factor. Industrial emissions, construction dust, road dust, and stubble burning also play a major role. A holistic approach addressing all sources is crucial for sustainable improvement.
 * Focus on Age, Not Emission: The arbitrary age cut-off might not always align with actual pollution levels. A well-maintained older vehicle might pollute less than a poorly maintained newer one. A more effective approach could involve stringent emission testing and enforcement, penalizing genuinely polluting vehicles regardless of age.
 * Shifting the Problem: Banning older vehicles from Delhi-NCR might simply shift the problem to other regions if these vehicles are sold off and continue to ply elsewhere, negating the overall environmental benefit.
A Call for Balance and Compassion
There is no denying the urgent need to combat air pollution in Delhi and Haryana. However, a policy that significantly impacts millions of citizens, particularly the economically vulnerable, demands a more nuanced and compassionate approach.
Instead of arbitrary age-based bans, the government should explore:
 * Robust Scrappage Policies with Fair Compensation: Offering attractive incentives for owners to scrap their older vehicles, possibly with subsidies for purchasing newer, compliant vehicles or electric alternatives.
 * Strengthened Emission Testing: Implementing strict and transparent PUC norms across all vehicles, irrespective of age, with severe penalties for non-compliance.
 * Investment in Public Transport: A truly effective solution lies in drastically improving and expanding public transportation infrastructure, making it a viable and attractive alternative to private vehicles.
 * Addressing Other Pollution Sources: A sustained and comprehensive effort to tackle industrial emissions, construction dust, and agricultural burning is equally vital.
The new fuel ban in Delhi and parts of Haryana, while legally defensible on environmental grounds, presents a complex challenge. It's a stark reminder that policies, even those with noble intentions, must be carefully crafted to consider their broader societal and economic implications, ensuring that the burden of environmental responsibility doesn't disproportionately fall on the shoulders of the common citizen. The "hole in the pockets of voters" might just be too deep to ignore.

Words of wisd

- prisoners in India a state subject
- center provides assistance for maintainence, modernisation, training etc.
- earlier women were treated as goddess now the times have changed
- a women is the sole holder for any house with several roles to be played like wife, sister, mother, daughter etc
- if you today think positive the change you make will be positive
- no system can help you change but only you can help you change
- as per dna report about 3700 women prisoners were in jail till 8thSep2014
- as per India today the women and children specially unwittingly become part of sordid system
- lack of family support makes them dependent on other prisoners
- Story of Nisanjael ( provided in the second email which was sent for motivational talk)
• Inmates not ready to make positive changes
• It makes it easy for the officers to shun their responsibilities because of this attitude
• It's not the fault of the system but of the attitude of prisoners
• If you do not change your attitude towards life and take a lesson from this then no one can help improve the various problems being faced by you in this system
- what you can do is plan to bring a change, educate others as to why not do such things ,get linked to Mahila yojna and help other women, serve your family, if your alone then government has several schemes under which they will promote women entrepreneurs which means that you all can together work and make a factory of what ever you are good in making may it be biscuits kr suits only like the Kalagram in Chandigarh holds a festival for all artisans giving them a huge platform to sell their products
- classification policies don't offer pursuit of job skills, nor maintaining clean disciplinary conduct, publishing credentials etc
- prisoners want to advance like every other person
- for this a first initiative must be taken by the person themselves
- all prisoners want positive change and create a better bond with their family
- want to reconcile with the society
- think of your family before you do such things
- think that what if your children if single then parents will have to face because of your fault from not only the police administration but also the society
- for a better future make a right change today

Time a crucial Factor In Politics

With the death of the popular punjabi music singer today , I.e 22.5.22, we see a lot of paid media buzzing and hypeing news to convince people of rivalry for personal vendata in the name of personal protection .
This time when media is busy giving statements of 10 to 35 and 200 guns rounds some questions strike my mind at this crucial time when these events are following up :-
1. Punjab has a new government which has just yesterday taken away security
2. 3rd attack in Punjab where not much damage has happened
3. Election of himachal and Gujrat are round and the bjp looks in a bad position in the city from where pm belongs .
4. BJP minister is arrested from another state.
5. Aap is busy with correcting its image by changing a minister alleged of corruption.

Note :- I'm reminded of the rpg attack in mohali where only 1 wondow broke
I'm also reminded of gun shots in SAS Nagar where no one died and then this, but in this lieu flags of khalistan are found to be risen in himachal only.

Now the questions I wish my reads to address are a mix and as follows :-

Now in medical legal terms the incident doesn't match with reality plus logics in the following sequence :-
1. His mouth and nose are full of blood bubbles - related to liver , stomach and heart disease
2. His car is hit with 10 bullets as per record shown and 3 or 4 of which only hit his stomach .
False statements of 35 and 200 rounds being rumored
3. He has a security going behind who did nothing
4. His mother who's only son died isn't in pain but in political vendata
5. None of the people in the car except driver died
6. Issue of security is raised by bjp only openly in media no one else is putting a statement
7. He owns big cars and is found in his thar who on being hit is found with open hair whereas he himself has more than 10's of guns

Logics
1. On seeing gun man ahead he stops car instead of running
2. His wipers are on meaning he lost control and didn't take our his own gun
3. He is found in casuals when he is popular as much as the PM
4. His security moves behind and no terrorist so called is ever shot
5. Connections of people already in jail who have no connection is brought

So is the political vendata bigger than a life ?
Are elections more important ?
Is the security so weak that we now want drones ?
Are vips so prone ?
People is jails have such good access without support of the power in present ?
Clean chit is given to intelligence?

Think as a common man ...
Vote for good not for goons

Need for a Governer

Respected Members of Society
Greetings,

The Golden Era was dominated by Britishers and while we took our independence we adopted their model of governance creating upon a watch tool mechanism called as a Governer.
Article 154 and 155 of the Indian Constitution empowered the Governer , who is a sparrow of the central leadership for all works and milonitoring of the States workings and it's development.
But with time the use of this has become similar to the condition of our independent bodies such as the ED, IT, Media , Judiciary and all other breaking the 3 pillars of the foundation of Democracy.
Today Delhi has become the best example of misuse of Power by the central government upon fulfilling its philosophy of an Orange Nation.
The manifesto which is the basis of the contract for the purpose of which votes are given is no longer honoured by the judiciary in scare and all the judiciary is being filled in is with dump of political mindset ignoring any and all of the same.
With such a development it is time the Opposition got united as One Body under 1 Title to propose a Bill for making Elected members of Rajya Sabha as the eyes and ears of the Central Ministry and Abolishing the powers of the Governor before the centre abolishes all powers vested to the people of India and Various State Governments.
Hence with this email we on behalf of India Risee wish that a note shall be pressed upon our suggestions to see a Progressive India Rather than a State run by uneducated goons raping and killing minorities and all the supports and voices that come against their views .
Only if the Opposition stands united can we be able to Save India.
With the consegitive wrong choices being made by the old sole opposition today the state of affairs has became a scary reason for the country to stand affirm and as one opposition against those who wish to buy choosen MP and MLA openly to form their own government at all costs of democracy

Jai Hind

Open Letter - Punjab Issues

Dear sir
Greetings of the day

We are a small group of legal professionals who run under one name with some other friends of various provisions for raising the voice of the people that is unable to be heard during thr course of any Legal Proceeding.

It brings within all of us a big sigh of relief when we see you talking opening on the open collation between the relatives, I.e akali and caption.

That further we would like to appraise you that apart from politics we as advocates and social workers are fighting the legal battle on the major issues of which we shall need your support to take this lead forward.

That further we are backed by several small stake holders from both Haryana and Punjab.

That further the problems being faced are in brief below :-

1) RERA Nexus

With the implementation of Rera a big scam is being played in the entire state of Punjab. The Chairperson and our fight is left to the wasted interest. The Government has legalized the illegal colonies for which there is no power and under section 69 of the same act the Government of Punjab should have penalized the developers and made a positive start which they have failed. Today the state is licensing buildings without license to develop because the chairperson of rera is a close aid to the caption and needs a change. The chairperson needs to be a Judicial man of integrity. Further more there are a lot of scams from day 1 which needs to see the light of the day.

2) Empanelment

That further you must be aware that it the AG of Punjab has already been accused of plundering the government of Punjab by calling advocates from Delhi to honour and favour them where is the truth is that the entire AG office of Punjab is bestowed and in circle around Mr Nanda who is again a close aide of captain and needs to be sent back to his home town Delhi for failing to get to the interest of Punjab.

3) Registration

The process of registration has taken a U turn vis-a-vis Punjab as money is opened the demanded making the lives of common man. SINCE AFTER RERA PEOOLE THOUGHT it will become easy but because how certain selfish motives it has become a mess 2 and sure that the central plan of Punjab ab is passed in the same manner the illegal colonies of Punjab are immediately stopped the allotment of land is done in an open basis and the development being done near the farmhouse of chief minister of Punjab clash the hotel of Ex Chief Minister of Punjab is done as per act and not favoritism.

4) implementation of policies

Punjab miserably fails to get its policy implemented throughout the nation only for the reason that the heads of the Institutions are made in such a way that they obliged the chief minister and his allies without having any version of growing the wealth of the state they are involved in looting the state through various operations.

5) use of land

The master plan of Punjab is different than from the actual plan being imposed in Punjab. Thereby meaning that Punjab is headed for a dumb by killing its own farmers and grabbing the land of its farmers was a purpose to satisfy the needs two people primarily e near and around their area of investment of properties in Punjab.

6) judiciary

Amongst many other issues Judiciary is one of the biggest issue today where only the clauses of the government are being promoted without having any merit are made either senior advocates for judicial advocates in various tribunals as well as quotes including the high court and are openly involved in favouring the government as well as encouraging mafia and thoughts of the central government for their own promotion beyond the constitution of India

7) appointments in tribunals

Appointment and tribunals is done of people close to the chief minister of Punjab which further dents the image and the need and purpose for developing such institutions the pool has taken out notifications only to benefit the people close to the chief minister and make the remaining mass of Sulphur by non-implementation of false notifications and promises to look into to the matters and compensate the government for what happened ants causing another use deficit in the pockets of the government of Punjab

8) Police recruitment

That Among many other issues Police recruitment still stands at still and favours are still being given to close AIDS of ministers and rather by putting aside the police Reforms Act 2006 which is a success in Kerala and a major way to blow up the Nexus between the government and to join the connection of the Government and its people.

That in order to try our best to save people and their interests from the cruel system of judiciary we have been fighting on both legal and social levels but with Punjab taking the lead and giving us assurance of rise in Haryana

your kind attention. Support as well as Interference in removal , transformation and systemisation of the Punjab Model that as

Dear Members of INC,

Since the start of the war between the 2 nations Russia and Ukraine only our paid media Has been promoting Sh. Modi ji to resolve the tension with his powerful words of saying Thank God I came back alive.
It becomes important for us as the only opposition to spread the message of Citizens first and take this opportunity on time to take the right attractive headline for elections.
The issues that will influence hereon shall be :-
1. Selling Airline
2. Crying videos of students
3. Congress interaction with students in Ukraine against Indian Government and Media
4. Sh. Rahul Gandhi talking to the Foreign Minister in Person for evacuation and receiving flights by various senior members of Our Congress to take the spot light away from these liars in BJP
5. Interviews of Congress stating stands our Previous PM took and helped people evacuate at times of need without to much of hoarding

The Death of Democracy

The nation witnessed one of the biggest struggles in the year 2014 when the BJP that is the current ruling party in India had created hype of an individual who was accused of mass murder in 2002 and several other criminal activities.
The nation was in its phase of passing through the highest age of corruption under the rulership of the UPA government which had been prevailing in power since a long era.
The nation was taken over by the claim of new to India keeping in mind the term of the tallest leader in the history of India that is Shri atal Bihari Vajpayee who had created one of the biggest economical and political achievements along with providing the people and equal opportunity to grow as well as develop socially to complete the global era.
The country now suffered from the greatest loss of being taken over by an individual who is marketing was based in their political campaign manifesto which is as good as a brochure and hence forth a part of the contract where in the citizens based upon these ideas dreams and fantasies workforce to press the fingers in the name of peace prosperity and progress.
But what this nation has seen is inequality illiteracy and greed in the name of religion cast colour political saffron age and skin.
The nation without realising was now being forced in an era where the four pillars of the constitution that is the judiciary the forces the parliament and the media had all been compromised for the sake of some printed notes which now had been used to develop an India of of an elected autocracy.
All the states where elections have been witness so the bluntness and cruelty which help force the entire mechanism of elections and highlighted the failure of the electoral bodies to take any cognizance or or to deliver any means and methods to try and save the dignity of this nation which was once the biggest democracy

It is time to rise and shine it is time to take care of the cloth of being an Andhbhakt

Economy Goes Parallel with COVID

The the pandemic all over the world that started way back from November 2019 is one of the most horrifying inventions that could have been done. The widespread virus that spread from Wuhan in China has not just created a panic in China but all over the world .
This virus had forced Korea to kill zone people who are infected with the fear that this virus could kill many others true people itself. USA one of the world's biggest and the most strongest country has miserably failed to curb this problem causing almost more than 9 lacs of people not just infected but deceased due to this virus.
In India the virus was confirmed by the ongoing government in centre and their timely awareness for precautions a country like India that has one of the biggest population strength has been able to successfully become the leader in controlling the wuhan virus or popularly known as covid-19. The the World health organisation and its statement as given several recommendations onto how a nation must curb the virus what all precautions must be taken and how long must it continue.
India has started its poor ties with this failure of a concrete plan to tackle the head on its own economy by the harsh decision of demonetisation followed by the newly implemented goods and service tax. The economy of the country had for the time being implemented several other laws creating a lot of loss to the nation's wealth and with the entry of the women virus things when just miserable for the industry.
Today the Indian industry suffers one is the biggest hits because of the match calculation by the chief advisory of this country full stop the government and its notification onto lockdown States that the lock down which had been started for 21 days chalna extend further until a concrete plan is put in place coma but on the part of our economics we fail to understand that the lock town which should have taken a parallel step with revival of the economy as taken India's biggest downfall.
India Today strike from the biggest depression and sholey after the completion of the lock town several industries shall be forced to stop producing for any state of misery is there is no economic package released by the government in ezone the government had taking note office on working postpone the people to win sure that they must face salaries to all its employees and shall not terminate any employee during the period of the pandemic. All associations and bodies of several corporates had agreed to pay the entire fees for the duration of March by adjusting the leaves but the extension from April and hence to me 2020 shall create a hole in the pockets of every individual. The Gunman in yet another step to eradicate the interest payments being paid had stated that people shell now get a nice why no payment of interest was actually e a mission statement by the ministers of the central government which led to an extended burden on the people rather than a vision of money and extension of money was now ready to be paid to the banks people that were earlier hit by the pandemic and no work are now it by the use prices that they are being forced to pay in terms of taxes black pricing of daily necessities, xcessive rates of gas, no economic packages salary for no work done, damages caused due to the pandemic.
As it is said it is never too late for any government to realise its own mistake and take certain characters measures at the earliest in order to revise the economy as well as the life of the people Sone after the government plans to lift up the lock down full stop hair after few recommendations that the government can easily do which are as follows:
1) the end of income tax for next 3 years
2) subsidised rates of necessities for all
3) no payment of taxes aur interest aur EMI during the period of lockdown and the same for the tenure of lockdown shall be adjusted after the lockdown is over but at a nominal rate and not at the previous existing rate
4) availability of loans at lower rate of interest extension of all loans at lower rate of interest, provision of funds for setting up Andre scheduling the loan structures of all business models after due verification
5) economic package for the poor in order to save the money and saving of all the people
6) only 2 slabs of taxes in the GST regime must be applicable being 5% and 7%.
7) exemption of existing defaults of loans and restructuring of all loans
8) extension of bs6 guideline Masti put until 2022 in order to revise the market
9) prices of various forms of gases must now be exempted from the previous existing tax and put under 7% tax slab of GST and being made available at unequal rate Pan India for the next two years.
10) prices charged at higher rate during the tenure of pandemic adjusted with the penalty @ 12% off the default price
11) all beautification rectification change of names and other link construction activities must be put to a fault for at least next 6 months.
12) the taxes levied by the government and private authorities under the control of the NHS must be put under one slap equal for all reducing the burden on the people.
13) the stocks and inventory is available with the government of people who had committed a default must be adjusted at nominal rates.
14) easy money e for initiation and investment into the own country by various foreign investors must be made with a stronger assertion on tyeps will local industries and setup must be made on areas of default in order to revise the construction that was earlier started and to ease the cost of investment.

RTI , your power to question

It's time that we Question the government and the other bodies to know what we should get and have received .
Our rights are the biggest power we have but still we ignore it .

we have proudly filed our Power to Question the government on money used on Swatch Bharat Abhiyaan
We question the intent of the leader in power in Panchkula .
In facts :-
1) a budget is passed on the notice of the prime minister of India that the scheme of Swatch Bharat Abhiyaan needs more portable washrooms
2) toilets are made and broken , locked , not connected , not accessable showing discrepancies
3) there are dusbins put up
4) another bill passed for rectification on letters to the officials and through media trials
5) dusbins now are seen to be removed
6) another bill this time for new 2 dusbins passes .
7) another bill now for beautician of toilet comes , money is used to maintain privacy.
8) Panchkula issues a vague notice to Beautify the round about to please their minister in charge instead of repairing government institutes or making roads etc and toilets are removed .
We wish to ask :-
1) Why make toilets without connections and with locks
2) why 3 budgets of the same toilet
3) why then remove the toilets in the name of beautification of the round about when 2 bills have just made it with a 3rd bill of beautification of it
4) why have round abouts change and probe there on going today when the state has suffered a massacare because of the governments failure , why not ease people's trouble?

Uri accidentally Promoting Guitars CM

The launch of 2 movies Uri and the accidental Prime Minister did not just raise eyebrows for all party supporters of a party but for all individual who had a faith in the working of the governmafter several ent got a hit. The role of Anupam kher for Manmohan Singh stroke up and big controversy in everyone's mind . Even several explanations by the actor couldn't give us the right answer because somewhere we as individuals knew the intention of the government is doubtful and the character assignation done by the actor has been an evident fact since long times so how to believe either one of them until a clear result is out .
The movie URI has got a great response from the media and people but the reasons for the thumbs up is the role of the Army and the biggest criticism has been the unnecessary involvement of the Prime Minister and his cabnit instead of focusing on the army the focus was seen bent to the government indicating what people just need to see.
The movie and thought was great but only if the timing would have been either after elections or without the excessive role of cabinet ministers as useless as any one else seen to be a part of the strike .
The part of accidental PM can be resolved only by the launch date and role being given to an actor of a neutral nature . So much so promotions of 2019 are being seen in the media houses now that the paid media seems to just sticking inside the cabins of the Guy who was elected as the PM in 2014 but is busy promoting a regional party as if he wasn't the PM but still the star campaigner of the bjp .

My problem isn't the compeinging but the lost dignity of the position with every wrong action and faulty promise each and everyone claimed until now.
Earlier the Nation saw a silent PM controlled by an Italian and today we see a bjp promoter just making Gujarat popular in every initiation of the government . The fact being that this CM of Gujarat isn't ready to take the post and retain the dignity of the post which is why he choose Gujarat First .

Nation needs a change in the entire political system which has been confined to local goons and big scammers which is why both major players are scared of prosecutions and smaller ones are being sold and purchased like useless rucks.

Be the Change ... Over through the garage in the bin of the government to enhance the nation in the ratio of years to independence.

Why is there a need to Boycott Controversial Writers

Many of you might have Heard the name of this controversial Writer , his novels once made sense to us and the reason why he became popular early became evident until THE FACEOFF.
Note- The facts given in this version where both contradictory point as well as actual facts are given is a true event and a Direct Response to all People With the similar Approach of Thought when it comes to thinking for the masses .
The Blog does not aim to target any particular segment but rather the entire similar minded fraternity of people that think that the current government through the orders by the Supreme Court have given them the right after removal of section 377 of the Indian Penal Code.
The Pure aim of this Faceoff is not just to retaliate to one but to clear the doubts of several like minded as to why do we need the section back and until when .
          The FaceOff - (Section 377)
On a fine evening with old friends where good old school days were being relived a new era of thought had also been following between us all.
Once those people that in the days of immaturity thought something which was entirely different to today's current scenario and the development that each and everyone had gone through over the period of time .
It was a pleasant evening when I met this controversial Writer in person after ages herein again after our first faceoff on a small opinion on Facebook .
Since after provocation the talk took it's place and questions by the controversial writer were raised as below :-
1) The Constitution gives us a right to be treated equally so what is wrong when we claim of our rights under section 377?
2) What does the section state word by word ?
3) Only people with a small thinking can think of reasons do not allow the LGBT to take their stand , since you have not seen the ajanta ellora caves you don't have an idea of the world around ?
4) When you haven't been out how can you claim you know the versus well ?
5) You are an advocate you might know and have read the law better but when you do not understand the meaning of the section how can you state a claim?
Some Questions faced by the general supporters of the LGBT Group
1) Not giving us rights is a hinderence to privacy what wrong have we done ?
2) You people don't have a knowledge of life how can you comment on 377?
3) Section 377 is only linked to the talks of LGBT .... And many similar more
To all those :-
The preamble of India states that ,
" WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens:
JUSTICE, social, economic and political;
LIBERTY of thought, expression, belief, faith and worship;
EQUALITY of status and of opportunity;
and to promote among them all
FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;
IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949,DO HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION "
Where ,
SOVEREIGN - externally free from the control of any foreign power and internally, it has a free government which is directly elected by the people and makes laws that govern the people
SOCIALIST - economic philosophy where means of production and distribution are owned by the State.
SECULAR - state will have no religion of its own and all persons will be equally entitled to the freedom of conscience and the right freely to profess, practice and propagate the religion of their choice.
DEMOCRATIC - The rulers are elected by the people and are responsible to them.
REPUBLIC - head of state is elected, directly or indirectly, for a fixed tenure. The President of India is elected by an electoral college for a term of five years.
Therefore when the basis of the Constitution doesn't discriminate us on the basis of caste, creed, colour or sex why should we discriminate the LGBT on any basis .
The LGBT is rightly accepted as part of the society as any other human and any discrimination has always been condemned but since the history we have only protected this sect of taste of people but not the people as an individual is what is the pretext to understand.
The people then had right to do whatever but wasn't entitled to complete right for a purpose to protect them and others from the mischevious and dirty minded part of the society that are bound to take advantage of the situation and cause harm which is of such a nature that it can never be recovered.
Even today when we are able to read only 1% of the online articles wherein some people have boldly come out and stated their agony that how an elder person with such a taste had used a young male child for a long time and the child had to keep silent in terms of fear. But beyond this is another fact in the hidden meaning to the line above that because it's a hidden fact there has never been a report for the same nor a count has been assessed for the purpose of Justice.
The Constitution of India states under Article 14 of the Constitution of India that states , " The state does not deny to any person equality before the law or the equal protection of the laws within The territory of India. protection prohibition of discrimination on grounds of religion, race, Caste, sex, or place of birth. "
This article like any other article is an interpretation to the preamble of our nation and in the matter in concern it must be noticed that the sect of LGBT have no relevance to any or either of the provisions as they aren't ;-
A race
A Caste
A Sex
A place of birth
A religion
But, a selected members as one of us who just have a taste which is different and to which the provision or section 377 of the Indian Penal Code made a restriction which had been titled as Unnatural Sex.
To put in mind it is important for the community of LGBT to be aware that the section wasn't just in concern to them but also of all other ways of having intimacy excluding the vagina of a women.
Section 377 had stated , " whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Herein it is important to know that it didn't just limit to the LGBT community but in fact the entire human fraternity for not having sex in any other way even if it had mutual concent and also not having sex with an animal .
Now the noted part of the Judgement titled Navtej Singh Johar & Ors. V/s Union of India stated  ,
21. CONCLUSION
i. In view of the aforesaid findings, it is declared
that insofar as Section 377 criminalises
consensual sexual acts of adults (i.e. persons
above the age of 18 years who are competent to
consent) in private, is violative of Articles 14, 15,19, and 21 of the Constitution.
It is, however, clarified that such consent must
be free consent, which is completely voluntary
in nature, and devoid of any duress or coercion.
ii. The declaration of the aforesaid reading down of
Section 377 shall not, however, lead to the re-opening of any concluded prosecutions, but can certainly be relied upon in all pending matters
whether they are at the trial, appellate, or
revisional stages.
iii. The provisions of Section 377 will continue to govern non-consensual sexual acts against adults, all acts of carnal intercouse against minors, and acts of beastiality.
iv. The judgment in Suresh Kumar Koushal & Anr.
v. Naz Foundation & Ors.57 is hereby overruled
for the reasons stated in paragraph 19.The Reference is answered accordingly.
In view of the above findings, the Writ
Petitions are allowed.
……………..……..…………………J.
(Indu Malhotra)
New Delhi;
September 6, 2018."
This clearly states that the section hasn't been completely waved off with but a portion of it has been put away for further reference and which needs to be passed now as an amendment in the books of law to be reorganized even at a later stage or else anytime further a 7 bench judgement can overrule the above stated judgement.
With the provision for LGBT to enjoy their taste the Hon'ble Supreme Court had to make a judgement based on the provided facts as is bound by the rule of law to follow the interpretations and protect the Constitution into which nothing has happened as until this date.
The LGBT community in India must also note that the government has also along with just sex being free mistakingly removed the provision of intercorse with an animal in specific in the judgement and waveritoff with an ambiguity in which the provision of the section can still be referred for brutal sex with minor and animal .
The basics of rule when we demand the Section 377 to stay is that since ages the private sex between a gender and the same or another gender has been allowed and so has the judgement made it clear to allow intercourse with concent in private but this isn't well possible as injustice to the other sects facing the outcome still remain in ambiguity with the definitions in the related sections of IPC dealing with section 375 - rape , 376 A - punishment for causing death or resulting in persistent vegetative state, 377 B - sexual intercourse with husband upon his wife during separation , 377 C - sexual intercourse by a person in authority , 377 D - Gang Rape , 498 A - Cruality .
The other acts where the amendment need to be made is :-
Special Marriage Act
Hindu Marriage Act
Indian Divorce Act
Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act
Transfer of Property Act
.... And all similar nature acts simultaneously when we say that the LGBT has been legalised or reorganized .
In fact ,
A bench of the Hon'ble court has laid it's view on the fact and is only valid until a revision or review is filed or a superior bench over rules this.
The history of Ajanta ellora caves Is linked to the history of our nation and as reorganised by the UNESCO it has popularly be known for its state of the art engraving and fine sense of making .
It takes a Hell lot of a Strong Minded LGBT member to look beyond the sculpture and inscription of fine art and Buddhist , Hindu and jain history to find that there have been engravings of sculptures that resemble people of a same fraternity and hence being in a relevance of art to a modern day judgement without being informed that the Indian Law was based on The Law of Land Prevailing in India and the history of the people of India is what complied the pride of this country in the form of a preamble which is the gist to the supreme law of land , i.e our constitution and the Hon'ble Supreme Court being the biggest protector of that pride for the purpose of its interpretation and enforcement with the concent of the people through its representatives , I.e the Parliament .
Henceforth ,
All talks on 377 stand ridiculed with and on 1 controversy that equality and justice are kept away from the others when there is an absence of Law .
Which is why the section must be revived in order to protect not one but all individuals until the law through its representatives paves a way.

I strongly believe to boycott people of this level of thinking that have been blindly influenced with an not tolerable approach because lack of knowledge is what leads to Injustice and a state of sympathy at the end of the day.

The Rise and the Fall of BJP hitting 2019

Every individual is a ap of the party irrespective of how and from where are the elections conducted from . The notion of a person based party isn't a myth anymore and the concept was first uncovered with the popularity of Indira Gandhi followed by Atal bihari Vajpayee giving the rise but it is also true that with a great name come entrusted a big responsibility .
The elections of 2014 changed the view of the nation on how a great known leader Narendra bhai Modi was born on a national level with intensive amount of popularity being based on Progressive Gujarat.

  • Gujarat being one of the most favourite places of the british empire took its shelter in the name of Narendra Modi and which is why the outset of the controversial leader when boosted to power in 2014 for the centre saw the biggest riot spree and revolution first from its own claimed zone bringing a rise to another opposition in the name of Kanhaiya.
  • As long as this episode took place the nation was made to witness the developing foreign ties of the current prime minister from the year 2014 to 2018 end giving them time to think again of what had they selected.
  • The controversy didn't just limit to the well to do ties but also grew up with the increase in national cost/ expenses spent on travel but the failure of the MAKE in INDIA camplain which could have easily caught up fire while the government had a good relation.
  • The to be known Chief minister of Gujarat who was known for its regulatory model , simple nature , indian choice of cars came in together into a new controversy of buying a new fleet of imported and protected cars.
  • The traumatic impact of Demonetisation which was implemented upon the entire nation without any backup resulting to a great loss of both wealth as well as lives in the process of change.
The Series of Controversies didn't just stop haunting the government here thereafter a controversial action of the government regarding the Rafale Deal came into limelight after which the centre had let out its other ain speaker Yogi Adityanath a current chief minister of the state of Utter Pradesh who gained importance and weightage as the man who could bring in development and change but had blown off the entire voters battle into a paid ground of supporters.
The religion controversy when done by a party influenced with the ideology was caught into the biggest controversy and blunder of over ruling the rules of R.S.S. ( a social benefiting organisation)

and also consecutively opposing the nations benefit for own clashes like extending the tenure of the establishment of the biggest temple in controversy the RAM Mandir arose a bigger hate.
By this time the Party that grew up in 2014 like fire in the name of MODI saw its worst slope in the state elections of 2018 irrespective of the wide promotions and efforts of the once so popular face Narendra Modi.

The business lobby had seen its worse after demonetisation a failure of act by the Government of India which arose a further controversy with the half implemented law termed as GST which slowly broke the professionals associated with it for the purpose of increase in costs and accounting per month here after. The increase in intolerance and the passage of certain controversial acts like the removal of Section 377 by the Supreme Court of India that got its popularity due to the half hearted steps by the government making another part of the society against the party.
The states that once were dominated by the BJP led government had to face the heat of a failure of both governments and leading to further proposed decline in the voters ratio.
it is time left of almost a few months before the nation again goes for elections of the Central Government and proposed corrective measures the government can save itself of heat are listed herewith as :-
1) Making online procedure easy.
2) Implementation of the BHIM app be made compulsory for transfer of money to decrease the popularity of the controversial PAYTM application.

Approch of People

Recent times have seen a wave of approach if people shifting in all parameters . The years from 2000 have not just seen a shift to the digital platform but with it the dependences towards this have also increased . Every growth and inclination comes with some odds and even from both point of view so being of the people as a part of the society or the approach towards various field .
Technology has undoubtly led us to think towards a new direction by not just keeping us touch in a way with people living far away and negatively finished that personal touch and associations as people chose to have way back for the purpose of interaction.
Love that once appeared as a matter of a lot of time so consumed us today just a click / swap away on the digital platform irrespective of its odds as well as even .
People have chosen to move smoothly with times but inability of the concerned authorities and government has not only led towards a systematic failure but also a rise in duty of the governments inability to safeguard people .
2014 had seen a growth with this as a turning point and revolution which got a jolt by the government concerbed with not so friendly approach and miss conduct done on people
2018 end here gives a hint to the rise of another chance another change of the flow .
Herein also the approach of the people has shifted from sticking to work and of officers of major government departments to refusal to work and get work smoothly done hence creating a trouble in the society.
Also it was seen that the approach of some people towards judiciary turned into disrespect so being reflected in the entire legal professional giving a rise to fakism and ignorance . It must be remembered today that the country stands on 2 pillars the armed forces and legal if either or both are I'll treated it can lead to a collapse
So when you decide you wish to see a change decide to be the positive change the society needs.

Failire of telecommunication mechanism

An unfortunate customer with Idea Cellular Pvt Ltd that has wasted almost a month with several emails and calls for getting issues addressed and showing a sincere determination towards a company which is least bothered about its customers write the following contents in his email to the ministry, pmo as well as the company and still gets no relief . The provisions of the TRAI act all fall in vein here in this particular case . The email sent was as follows:-

"  With them I have also notified the ministry of telecom services about my dispute also even the appellate authority has been averted on all issues and shamefully this system stands to a big failure and fraud in the name of consumer redressal for which I hold the entire system responsible .

My loss has only increased from a base starting on the 20th of may when Mr. Nitin was contacted regarding my concern .

It is sad that all of the following issues have not been touched if touched by mistake then not dealt and if by chance some people like Pramod who tried to deal have not either reported or taken a follow up which has lead to increase in mental agony and personal concerns for which I hold the company wholly and solely responsible for acting fraudulently on genuine matters so being :-

1) no service being persistent in C-125 sector 19 Noida

2) low service in metro from Noida to Karol Bagh which gets a no signal for almost 20 min showing their poor commitment towards their customers

3) poor signal and no service in office address of which is so being opposite Jain cooperative Bank , street number 23 Faiz road , Karol Bagh

4) fraudlent charge of Rupees 811 that were imposed forcefully making my bill amount to RS. 1433 for the fault of the company which clearly as stated in earlier concerns was that at times with signals only the internet responded and never did the calling system

5) no answerability towards the financial loss caused because of an unprofessional approach and no SMS alerts ever given for such poor services

6) no answer by any authority as to one basic fundamentals question of barring my Right to life under article 14 of the constitution of India which leads to right to speak may it be any medium by barring of my services for fraudulent charge of RS. 811

7) no follow up has ever been taken up nor has any senior official tried to resolve the dispute may it be from the government office involved in getting the merger of a fraudulent company with Vodafone or the company itself taking the responsibility for such acts

8) no reply has ever been made to the simple fact that if u charge us for over usage then why don't you pay us for every no service which is the basic grounds of the contract into which a customer and company get into .

9) TRAI and Dot have not bothered to interfere through their customer grivence emails hence promoting the fraudulent actions of these telecommunications company in the name of customers benefit .

10) The ministry of telecommunication has also been averted has yet no assurance of any sort of remedy has been available to the customer making this an issue everyday for fraudulent conduct and cheating being rampently done by companies and promoted by ministries .

I write my contentions to you today to avert and alert you as to the consequences of infringing not only the contract and making it void ab nitio but also curtailing my fundamental rights and it all to have been let it go on under the supervision of the authorities which were made as per the law for once being the guardians to the voice and rights of customers .

I request you to look into my matter and take a strict action imposing the Company Idea Cellular with huge costs for no system and mechanism of grivence redressal and also tighten up bodies like ministry of telecommunication , TRAI and Dot for their silence which has only promoted the failure of an entire system of justice in regards to telecommunication services with several customers being the prey to the cheatings and fraudlent transactions by these co-operate giants . "

Imagine the plea of several customers that show their grivence in various ways and even then the government chooses to turn a blank eye upon all this and much more .

Is this how you govern and maintain a system ?

Is this how you let the fraud stay persistent even after being alerted ?

Is this how you let a co-operate crush fundamental rights of customers as well as the impeachment of contract ?

Is this the procedure of the bodies made for the protection of customers to protect their customers by scrapping and ignoring their grievances ?

Why should Haryana suffer again

What people Believe and what I saw on a personal travel trip :-
The followers of The accused Saint in question want to meet him which means in his Dera they don't get the time to meet him.
The followers are allowed to enter for the support of the accused while they know the charges have been framed and the party has been sold and made to sit silent.
The trust in the centre and the state or the judicisry shall come to an end tomorrow no matter what happens.
The resignation of such A Chief Minister of the state is primarily important as much is the execution of such accused important before any judgement in their places.

While I was on a driver from the city in question to a city in Punjab for some personal work it was clearly seen that the buses filled with followers were being allowed to enter Nd even after section 144 they were allowed to settle into groups in numbers as big as 1 lac.
The state was aware but the administration and political class preferred to sleep on the entire issue to let the pressure be built on the people as well as the judicisry. It is true that no action was either taken nor was instructed because the Government sold the states justice and decipline to the accused. The judgement if made against the accused the state will burn to hell if in favor justice will burn to hell forever and with this the name of Rss and BJP shall be buried under the mud for years to come because after the previous 2 incidents so being of Rampal and Jatt agitation it has been clear that nor the state Government nor the centre is in any mood to deliver justice to its people...

To all Citizens with supreme integrity on behalf of many civilian stuck I would just like to say a few things :-
1) BJP Government is the biggest failure ij Haryana and resignation of the entire cabinet should be demanded before panchkula sees either of the execution.
2) any riot or war happens not because the system is weak but because the people in charge are weak enuf to act for the justice of their own state and people
3) the minister in charge must take full responsibity towards the people that voted them to power and not the powerful saint to kill the procedure of justice
4) The Failure of the centre and opposition has made the situation come to what it is and hence none of the politicians have any right to comment on life's of a common man
5) our Prime minister has miserably failed because of his useless cabinet and resignation shall be demanded from him as well for letting a state burn 3 times in his own party's tenure .

Yogi Adityanath

Mahant Yogi Adityanath  born on 5 June 1972 is an Indian priest and politician with a fanatical Hindu MP  image. Now he Become 21st Chief Minister of the state of Uttar Pradesh. Yogi has a dual image in his surrounding ,if we concentrate on his image one side he found with fanatic Hindu Pioneer and other side looks a emotional candidates which  cried when he get torture from there enemies.

Finally on 18th march Yogi unanimously elected has candidates for UP CM post by BJP parliamentarycommittee. A star campaigner for the Bharatiya Janata Party (BJP) in the state, prior to being the Chief Minister, he has been a Member of Parliament from the Gorakhpur Constituency, Uttar Pradesh for five consecutive terms since 1998. Adityanath is also the Mahant or head priest of the Gorakhnath Math, a Hindu temple in Gorakhpur, following the death of his spiritual “father,” Mahant Avaidyanath in September 2014. He is also the founder of the Hindu Yuva Vahini, a militant youth organisation that has been involved in communal violence.

Yogi Adityanath Priest of Gorakhnath math belongs to Pauri  Garhwal WHICH IS NOW IN UTTARAKHAND . Yogi takes oath as UP CM on 19 march with his 2 Deputy CM.

Yogi Adityanath was born as Ajay Singh Bisht into a Garhwali Rajput family on 5 June 1972 in the village of Panchur, in Pauri Garhwal district of Uttarakhand (formerly in Uttar Pradesh). His father Anand Singh Bisht was a forest ranger. He completed his Bachelor’s Degree in Mathematics from the Hemwati Nandan Bahuguna Garhwal University in Uttarakhand.

He left home around 1990s to join the Ayodhya Ram temple movement. He came under the influence of Mahant Avaidyanath, the chief priest of the Gorakhnath Math, and became his disciple. Subsequently he was given the name 'Yogi Adityanath' and designated as the successor of the Mahant Avaidyanath. While based in Gorakhpur after his initiation, Adityanath has often visited his ancestral village, establishing a school there in 1998.

Scholar Christophe Jaffrelot states that Yogi Adityanath belongs to a specific tradition of Hindutva politics in Uttar Pradesh that can be traced back to the Mahant Digvijay Nath, who led the capture of the Babri Masjid in Ayodhya for Hindus on 22 December 1949. Both Digvijay Nath and his successor, Mahant Avaidyanath, belonged to the Hindu Mahasabha and were elected to the Parliament on that party's ticket. After the BJP and the Sangh Parivar joined the Ayodhya movement in the 1980s, the two strands of Hindu nationalism came together. Avaidyanath switched to the BJP in 1991, but nevertheless maintained significant autonomy. Yogi Adityanath was appointed Avaidyanath's successor as the Mahant of Gorakhnath Math in 1994. Four years later, he was elected to the Lower House of the Indian Parliament (the Lok Sabha).

After his first electoral win, Adityanath started his own militant youth wing Hindu Yuva Vahini, which has been known for violent activities in the eastern Uttar Pradesh but was instrumental in Adityanath's meteoric rise. There have been recurrent tensions between Adityanath and the BJP leadership over the allocation of election tickets. However, the BJP has not let the tensions mount because Adityanath has served as a star campaigner for the party.

Adityanath was the youngest member of the 12th Lok Sabha at 26. He has been elected to the Parliament from Gorakhpur for five consecutive terms (in 1998, 1999, 2004, 2009 and 2014 elections).

Adityanath's attendance in Lok Sabha was 77% and he has asked 284 questions, participated in 56 debates and introduced three private member Bills in the 16th Lok Sabha.

In 2005, Adityanath led a 'purification drive' which involved the conversion of Christians to Hinduism. In one such instance, 1,800 Christians were reportedly converted to Hinduism in the town of Etah in Uttar Pradesh. He said, "I will not stop till I turn UP and India into a Hindu Rashtra (Hindu state)."

In January 2007, an altercation occurred amidst a Hindu group and Muslims during a Muharram procession in Gorakhpur which led to the hospitalisation of a young Hindu, Raj Kumar Agrahari. The District Magistrate made it clear that Adityanath should not visit the site as it may inflame tensions. He initially agreed but after Agrahari died, he disobeyed the magistrate and travelled to the site with a group of his followers. Adityanath started a non-violent dharna on the site. However inflammatory speeches were made and some of his followers set fire to a nearby mazar (Muslim mausoleum).A curfew was implemented by the local police, but Adityanath broke it and was subsequently jailed under Section 151A, Sections 146, 147, 279, 506 of the Indian Penal Code. He was arrested and remanded for a fortnight, on charges of disturbing peace. His arrest led to further unrest and several coaches of the Mumbai bound Mumbai-Gorakhpur Godan Express were burnt, allegedly by protesting Hindu Yuva Vahini activists. The day after the arrest, the District Magistrate along with the local police chief, were transferred and replaced. This was "widely perceived" as a result of "Adityanath's clout" with the Uttar Pradesh government of Mulayam Singh Yadav. The tensions soon escalated to riots across Gorakhpur leading to the burning of mosques, homes, buses and trains. After his release, Adityanath protested his jailing in the Parliament.

In 2010, when opposing the Women's Reservation Bill, Adityanath has said that reservation doesn't affect women's domestic responsibilities like childcare. He added: “If men develop feminine traits, they become gods, but if women develop masculine traits they become demons… Western ideas of women’s liberation should be properly analysed in the Indian context.”

In March 2011, the documentary film Saffron War - Radicalization of Hinduism accused Adityanath of promoting communal disharmony through a Virat Hindustan rally in rural Uttar Pradesh.Adityanath shared the stage during a hate speech in which an unidentified speaker urged the Hindu audience to dig up the graves of Muslim women and rape the corpses. Recording of this event went viral on social media in March 2015.In August 2014, political activist and lawyer Shehzaad Poonawala wrote to the National Commission for Minorities demanding that a police First Information Report be filed against Yogi Adityanath.

In an undated video that surfaced on YouTube during August 2014, Adityanath, reportedly during a public speech at Azamgarh, referring to the religious conversions due to inter-religious marriages, has said, "if they take one Hindu girl, we will take 100 Muslims girls." In the same video, he continues to say, "if they kill one Hindu, there will be 100 that we" and pauses, as the gathered crowd shouts: "kill".

In June 2015, Adityanath, while talking about Surya Namaskara, and Yoga has said, "those who want to avoid Yoga can leave Hindustan". He added, "my humble request to those who see communalism in even Sun God would be to drown themselves in the sea or live in a dark room for the rest of their lives.

During the intolerance debate in the Indian media in late 2015, Adityanath compared actor Shah Rukh Khan to Pakistani terrorist Hafiz Saeed. He said, "Shah Rukh Khan should remember that majority population of the Country made him the Star, and if they boycott his films, he will also have to wander on streets. It is unfortunate SRK is speaking the same language that of Hafiz Saeed."

On 3 January 2016, a day after the terrorist attack on an Indian air force base in Pathankot allegedly by Pakistani terrorists, Adityanath said, "The Pathankot attack has once again proved that Satan could change for the better but Pakistan cannot".[67]

Adityanath has praised the US President Donald Trump's decision to enact a ban on citizens from 7 Muslim-majority countries entering the United States and has called for India to adopt similar policies to tackle terrorism.
