(1) on 26/1/1950
- Domicile (ar.5)
> 2 conditions :
A) indian domicile on commencement
B) • born in India • either parent in India • O.R for 5 yrs before commencement
> 2 types
A) origion
B) choice
- from pak (ar.6)
> 2 types
1) before 19/6/1948
O.r since migration
2) after 19/6/1948
Recides atleast 6 months before application
- to pak (ar.7)
If he leaves India for pak ar. 5 & 6 won't apply to him after 1/3/1947
- indian origin (ar.8)
1) either parent or grand parent born In India
2) o.r o/s india deemed to be Indian only if parent is I.O
Ar. 9 -> taking citizenship voluntarily of any other country
(2) Ar. 11 -> after commencement
On or after 26/1/1950
A) birth (u/s 3)
B) decent (u/s 4)
C) registration (u/s 5)
D) Naturalisation (u/s 6)
E) taking territory (u/s 7)
They all come under the citizenship act of india, 1955
Termination
1) renunciation (u/s 8)
Voluntry leaving
2) termination (u/s 9)
Cancelation bcoz they took another citizenship of another state or country
3) deprivation (u/s 10)
Central govt removes it
Note - if the govt gets a person who applies for citizenship and is a distinguished member in fields like arts, literature, scientists, human peace then no condition like intention or knowledge of language or oath or good character need to be seen he can be a citizen by discretion of the central govt.
